What is Mediation?
As an alternative to litigation, mediation is typically less expensive and less time-consuming, leaves control in the hands of the disputing parties rather than a judge and jury, and leaves the parties free to fashion their own solutions. The sooner you can get your personal injury case settled for a "fair and reasonable" amount, the better off you will be. Similarly, the sooner an adjuster can get his/her file closed for a "fair and reasonable" amount, the happier they’ll be as well. Free Consultation

Preparing for Mediation
In many ways, our lawyers in a personal injury case prepare for mediation in the same manner we prepare for trial, excluding, of course, witness preparation. One of the many differences is the fact that you can speak to the mediator before the meeting. Can you imagine picking up the phone a week before trial and asking the judge questions about the hearing?

Procedures for Mediation Mediation is a service performed by an attorney to meet together with the other party and their attorney, and the insurance adjuster. This meeting is facilitated by a trained, impartial mediator. The mediator will let each side tell their stories. Then the mediator will meet with each party privately to assist them with a process that helps the attorney or adjuster assess the case for his client and to see if the claim can be satisfied without having to go to court.  He will begin an assisted negotiation process until both sides agree on a fair settlement. The mediator will not, repeat, will not make a decision for the parties. They will make the decision themselves. Why should I consider Mediation?
The purpose of facilitative mediation is a fair and impartial resolution of legal disputes. This process is quicker and far less expensive than a lengthy trial process.  It’s a good procedure for fender benders; as well as multi million dollar wrongful death actions or medical treatment disputes.  Mediation is a good process because it allows the parties to keep control of the decisions rather than depend on the mood of a jury or judge. Binding Mediation
Binding Mediation is an alternative procedure where the mediator knows beforehand that if the parties cannot agree, the mediator will enter a binding decision.  The parties agree beforehand to be bound by the decision of the mediator. Free Consultation
